This addendum supplements the Master Services Agreement between you and Sympler, LLC d/b/a 72 Hour Web Design ("Sympler," "we") and applies to your AI Agent subscription (Basic, Enhanced, or Advanced tier).
We provide an AI-powered chat agent embedded on your site, configured to handle common customer questions and qualified lead capture using your business information. The agent is built on third-party AI infrastructure that evolves continuously.
AI agents will occasionally make mistakes. They may answer a question incorrectly, miss the customer's intent, or fail to capture a lead. We tune the agent based on real conversations and your feedback. AI is not a replacement for human judgment on complex matters. We do not guarantee accuracy, completeness, or appropriate handling of every possible customer interaction.
You are responsible for providing accurate business information for the agent to use, reviewing flagged conversations, and instructing the agent when you want it to escalate to a human. You are responsible for compliance with regulations specific to your industry (e.g., HIPAA, legal advice rules, financial advice rules) — if your industry has restrictions on automated communications, we will configure the agent accordingly, but ultimate compliance responsibility is yours.
Conversation data is stored to improve agent performance. Personally-identifying customer information collected by the agent is your data and you are the data controller. We process it on your behalf.
Cancellation requires 30 days' written notice. Submit cancellation through your customer portal or email [email protected]. The agent continues to run through the 30-day notice window and you remain liable for the full monthly fee during that window. Billing stops at the end of the window.
All AI Agent fees are non-refundable for any reason — including dissatisfaction with conversation quality, individual agent mistakes, or any other circumstance. See Master Services Agreement Section 6c for the full no-refund policy and Sections 1-2 above for limits of AI. By signing this agreement you confirm you understand and accept these refund terms.
Sympler, LLC reserves the right to modify these AI Agent terms at any time, in its sole discretion, with or without prior notice. Updates will be posted at https://72hourwebdesign.com/legal/. Your continued use of the AI Agent constitutes acceptance of the current version.
By signing, you authorize Sympler to retain your typed name, IP address, browser user-agent, timestamp, and the version of this agreement as evidence of your electronic signature under the E-SIGN Act and applicable state law.
